You're 22 and Someone Wants You in the Passenger Seat: Who You Can Legally Supervise
Younger adults get asked to teach driving all the time — by siblings, by parents who never learned, by friends. California draws the line by the learner's age as much as yours. Four hypothetical asks, four different answers.
Ask 1: your 16-year-old brother has a permit
Say you're 22 and your brother wants practice before his test. Under Vehicle Code section 12814.6, a minor with an instruction permit may drive only while accompanied by and under the immediate supervision of a California-licensed driver 25 or older whose driving privilege is not on probation. The age requirement does not apply to the permit holder's parent, spouse or guardian, or to a licensed or certified driving instructor.
Answer: not yet. At 22 you are none of those, so his practice hours have to happen with someone else in your seat.
Ask 2: your 17-year-old sister just got her license
Say you're 21 and your sister, licensed three months ago, wants to drive you both home from a concert at 11:30 p.m. For the first 12 months, a provisional licensee may not drive between 11 p.m. and 5 a.m. or carry passengers under 20 unless accompanied by a licensed parent or guardian, a licensed driver 25 or older, or an instructor.
Answer: your being in the car does not lift either limit. You can drive, or she can wait for a ride from someone who qualifies.
Ask 3: your mom is learning at 45
Say you're 23 and your mother has an adult instruction permit. The DMV's handbook says a learner practices with a California-licensed driver who is at least 18 — 25 for minors — seated close enough to take control of the car.
Answer: yes, if you hold a California license. Before the first lesson, confirm the car's insurer knows a permit holder is practicing in it; companies differ on whether they want an adult learner listed now or at licensing.
Ask 4: you are your younger sibling's legal guardian
Say you're 24 and a court appointed you guardian of your 15-year-old sister. Now the statute's age requirement does not apply to you, because it exempts a guardian. You would also be the one who signs her application — the DMV treats that signature as accepting financial responsibility for her — and the one who certifies her 50 practice hours, at least 10 of them at night.
Answer: yes, and the insurance is your job too. She belongs on the policy for any car in your household she drives once licensed, and your carrier should hear about her at the permit stage.
What being the supervisor means in practice
- Sit where you can take control. That is the legal test, and it rules out supervising from the back seat or while distracted.
- The car's policy is the one in play. If you supervise in your own car, your insurer needs to know a learner is driving it.
- Your license has to be in good standing. For minors, the statute bars a 25-plus supervisor whose privilege is on probation; any supervisor should be fit to drive the car themselves.
The mistake to skip
Do not let a younger learner "just drive around the block" with you because no adult is available. If something happens, the driver was unlawfully driving, and the conversation with any insurer starts from there.

Can a 21-year-old supervise a 16-year-old with a permit in California?
Generally no. A minor with a permit must be supervised by a California-licensed driver 25 or older, unless the supervisor is the minor's parent, spouse, guardian or a licensed instructor.
Can I teach my parent to drive if I'm under 25?
If your parent is 18 or older with an instruction permit, the DMV handbook allows practice with a California-licensed driver who is at least 18, sitting close enough to take control.
Does riding with my provisional-license sibling let them drive after 11 p.m.?
Only if you are their parent or guardian, a licensed driver 25 or older, or a licensed instructor. Otherwise the 12-month night and passenger limits still apply.
